"Never have I ever been arrested" -> Sheldon drinks

Hey y'all. A quick question that I think can be explained easily, but after some light googling I couldn't confirm this.
When they play "never have I ever" Sheldon drinks after Leonard plays "been arrested". He then goes on to explain the jaywalking story. But Sheldon was arrested when he tried to not pay the fine for the driving ticket, right? Or does that not count as being arrested, since he was put in jail in a courthouse?
