North Carolina Birth Certificate Name/Sex change questions and answers!

Post Body

So recently I obtained my newly corrected birth certificate from the state of North Carolina! I had someone see a question I asked recently and they PM'd me with some questions on the process so I figured I would do a write up to hopefully answer any questions anybody else might have!

Edit: I wish I wrote gender marker change in the title. I was thinking in legal terms of how I filled the paper work out when I wrote the title so it came off blegh.

Amendment Form

https://vitalrecords.nc.gov/documents/NCOVR-BirthModificationsApplicationFinal-07072022v6.pdf

Fill this form out and have it signed and notarized! I had mine notarized at my bank! I didn't have any issues with this format, the link below is EXACTLY how I filled mine out! of course, inserting the actual information in the big blocks in the middle.

For the bottom section, if you are 18 , you will be the ONLY applicant and applicant 2 will be left blank. I wrote "SELF" in the relationship to applicant section.

Money Order

You need to get a money order for $39 and make it out to " N.C. Vital Records". This can be done at wal-mart, similiar local stores like that, or probably even your bank! I got mine done at Fred Meyers, a local store like wal-mart kind of!

Drivers license/gender marker proof

I provided a photocopy of my out of state drivers license both FRONT and BACK with my correct sex on it. Both were in color. They accepted this alone without proof of SRS or a doctors letter and corrected my sex instantly.

Name Change Court Order

I also provided a copy of my name change court order from out of state. Make sure it has the crimp/bump seal on it as it has to be a true certified copy! My first one was denied because it didn't have the crimp/bump seal but after I got that and sent the new one in, it was accepted instantly!

Misc. Information

So I tried to call North Carolina Vital records numerous times and leave voicemails with the questions I had. I never got a return call. I got frustrated and said "Screw it" and sent in all of this stuff and would just deal with whatever came. So I will try to answer questions I think you might have!

Q - How long does it take?

A - A long time. It took like 5 months to hear my first response back from them. They sent me a letter in the mail saying they accepted my gender marker change but not my name change because of the missing bump/crimp seal. After I sent the new one it took roughly 1 month after that to get my new birth certificate. So a total of roughly 6 months for me.

Q - Does the new birth certificate out me in any way?

A - No. I was desperate to find out this information prior to sending all of this stuff in and I couldn't get an answer. Information was non-existant so I'm making that information available. Your new birth certificate in no way will out you. It reads as if you were born with your correct sex and name. There is no mention of an old name, or old gender, or sex change of any sort. It is a new, single page document that may be like your original depending on your age! The new one looks wildly different from my old one!

Q - What do I need to send in as proof for my gender marker change?

A - I used my out of state drivers license with the correct sex on it. They immediately accepted it without issue. I'd imagine if your NC drivers license has your correct sex they will also accept that.

Q - Do I need to provide proof of surgery or a doctors note of some sort?

A - No. I did not provide any of this.

If you have any questions I can try to answer them in the comments, but I am really hoping this information helps somebody trying to get their certificate amended in North Carolina! The lack of information when I was trying to do it combined with the lack of communication from N.C. Vital Records made this process miserable for me. I HIGHLY HIGHLY recommend you do it NOW if you have the correct documents. This only recently became available due to a recent lawsuit and there is no telling how long it will be before they try to change it and make it harder again, so my advice is ACT NOW!
