OK. So. At my job we've never had either unpaid lunch or paid breaks. Like ever. In fact, the pay system is super fucked and after I leave I'm thinking of going to an attorney about it. But, how the job works is you are given a truck at the start of the day by yourself and go on a given route to go house to house for our service. That's basically the job. But, drive times from the shop to the route can be LONG. I mean 40 minute drives. I'll save this bit for later.
So this job you get your hourly bonus. The bonus is calculated from how many houses an hour you do. So if I do 6 houses an hour, I only get my base pay. If I do 8 and up, I get the base plus a bonus that increases as my houses per hour increases. Here lies the problem.
We're pressured to get everything done every day. Which we can. But we don't get any mandated breaks at all. They're never saying hey, just take a break, we all go off and do our own thing. And that's fine. But add a break into my paycheck. I'm getting ahead of myself but the way the pay system works for everybody since we all get the bonus pretty much is that our "house score" which says how much bonus we have is our personal average for all of our hours during the pay period. If I do good one day, and do bad another then it all averages out. But on the drive back, our "house score" goes down dramatically. And I've been doing the math since I got here. When I finish my day on the route, I calculate how much bonus base pay I have. So say I'm done and just about to head to the shop, with 7 hours at a total of $20/hr I've made $140 total for the day. Not bad. But then I get on the road back to the shop. 30 minute drive. The shop is backed up for me to clean my truck etc etc. My total earnings for the day is the exact same as when I left the route... explain please.
Please someone tell me if this is at all legal for them to do because I've been here a year and it boggles my mind how this can be legal.
Edit:I'm in las vegas, NV, USA. Oh and no paid sick days or vacation and no Healthcare for fulltime employees. No benefits whatsoever apart from getting paid.
