I would like to hear your thoughts on this. I'm cis but here's my opinion.
The government generally should not regulate bathroom policies. I'd like to illustrate why with an analogy.
A little person walks up to buy a ticket for an R-rated movie. The employee thinks he's a kid and gets into an argument with him until finally he pulls out his ID. The little person was really self-conscious about his condition and he starts to feel terrible.
City council hears about this. They decided that in order to avoid making little people feel worse about their condition, all businesses must take a customer's word for it when they say they are an adult. Otherwise they can be sued for discrimination.
All the little people in the town feel better that businesses must believe they are adults, but suddenly this results in other issues. Soon kids start trying to watch R-rated movies. Some teens try to get into bars and strip clubs. People who are obviously not adults are allowed to get into whatever business they want because the managers don't want to get in trouble for breaking the law.
Granted this is by no means a perfect analogy and it's kind of nonsensical. And businesses don't ask for ID or medical records before someone can enter a bathroom. But I hope it illustrates this point.
The potential for abuse of a top-down policy is so great, it's best to just allow businesses to use their own discretion.
