Asking for a friend
I am the primary leaseholder on a lease at my 2-bedroom apartment. I rent out the second bedroom on a plain paper roommate agreement to people. The last roommate stayed with me for 2 years, we vibed pretty well after which she decided to move out into her own place.
Had a new girl come into the second bedroom who’s been problematic since day 1. It was agreed that she would pay first plus last, but she only paid first when moving in. Been asking her for the last and she wouldn’t send the money. She sleeps on the living room couch, keeps making mess in the apartment. I gave her notice to move out August 31st after which I have had a couple people come in to visit. There was a viewing for 5pm planned earlier today for which I informed my existing roommate and she wrote “OK.” At 4:30pm though she tells me “no one is allowed in my room because I have a class to attend.” She did not attend the class in her room though, attended it in the living room while saying “I deny you permission to go in my room.”
I tried to speak with her at which she started shouting at me, using abusive words and the fuck word, kept telling me I was doing “illegal shit,” that she wants to speak with the landlord. She really made me feel like she would hit me or something. I went to the police to talk about this and they said “it’s all in your head, what if the sky falls down? We can’t do anything until she physically harms you or something.”
What are my options? Can I kick her out sooner than August 31st? What about kicking her out on a day’s notice? Can I legally enforce it and have the police come and evict her?
