Apartment Flooded on first day

Need advice. I moved in to a new unit at my complex (literally 8/21) and we happened to get some rain in Texas. Well, I was woken up by my roommate at 3am to notify me that the apartment had flooded. Completely flooded, about 1-2 inches of water covering the whole apartment. My question is, what are my rights here as far as not being liable for these damages, since we were only there for less than a day? I don’t want to have to go through my insurance (another story on that) for damages that were caused to a unit that clearly wasn’t ready to be occupied. I don’t believe there were any other causes that could’ve been the direct reason for it being flooded other than poor construction maybe. Any advice is greatly appreciated!!
