Manslaughter is still an awful crime, but we have a legal difference for a reason, and that's what he would have gotten. Kendall is a dark man, but the waiter is also obviously a seasoned drug user and fully agreed to get himself in that situation. More importantly, murder requires intent - obviously Kendall would never have wanted that to happen. Also, I honestly feel like if Kendall had seen the waiter struggling in the water he would have dived in to try to save him. He should have called the cops and gone to jail but he would've got what he deserved, 2-4 years, not a murder charge and Logan definitely led him to believe he would've gotten more in order to manipulate him
