I have a question regarding the possibility of SF EX characters in SF V.

I was watching Max's stream last night and if I recall some people were asking him about certain EX characters making it into SF V, he kept saying how awesome that would be but he also said it's up to Arika (of course that's just paraphrasing.)

So really the question is, why would Capcom need licensing permission to use any of those characters? I stopped really playing games during the time of the EX games, but I was under the impression that Capcom owned rights to all of the characters under the Street Fighter brand.
