Paying bill if not received equipment?

I’ve seen some posts here lately regarding not receiving equipment. I’m in the same boat - I’ve put my order in for my new apartment, and I haven’t received equipment yet.

In fine print on their bill it says the cycle starts when you activate your equipment OR when 8 days have gone by from placing the order.

Surely they can’t charge me if the equipment takes 10-12 business days to ship out and 2-3 to arrive? Not being frugal by any means, but on a $200 monthly bill, that should be a $50 reduction..
