So landlord had a clause for month to month with 45 days notice of either party canceling lease. He is canceling our lease on the 26th of December. However has not provided any and I mean ANY written form. I want to leave by the first of December and be gone by then so I don’t pay Decembers rent. My lease expired on the first of September this year and has been month to month and that’s where the 45 days rule comes from. I told him today I found a new place when he told us to find a new place by then which I did. And is now requiring me to pay the prorated rent until the 26th of December. Do I have any recourse to say fuck off im moved out, here’s my notice bye. Or am I fucked? (This guy is doing way more than this but that’s for another courtroom where I’ll be on the other side testifying) If anything I’m going to JAG tomorrow with this and potentially my commander after all this is done to make him accountable but I need at least some answers now so I can plan this next month with the holidays
