my life partner abandoned her position, ownership of the house we purchased in 2020. i refinanced in 2021 and removed her from the loan. however she is still listed on the Deed of Trust. she said she is willing to sign a Quit Claim outright. i have some legal advise recomending that i contact the loan origin lender and see if there is a due on sale clause. I have been trying to contact that agent, have been unsucessful at the moment. is it wise to just go ahead and have the Quit Claim be filed to remove my ex, or should i be worried about the potential buy out clause. NO money is being exchanged, and i can prove i was the only payee of the mortgage sence the day of close. she has not been on the property in over a year now, and wants nothing to do with the potential equity within.
