So we closed on a home last Monday (11/13) and at closing, the seller mentioned that he hadn’t been able to get all of his tools out of his shop, but would have them removed by that Wednesday (11/15). I told him no biggie, since I had all my tools, lawnmower etc in an enclosed trailer and it would probably be a couple of days before I got to unloading it. Flash forward to today (11/21) and the seller has been to the house every single day and piddled around the shop, gotten a few things, and then left, but no noticeable progress has been made.
I am willing to show a little grace in the situation as the seller is an 80 y/o widower, but the patience is wearing thin. He showed up yesterday while I was at work, rang the doorbell, talked to my wife, and then burst into tears. We immediately called our realtor and said somebody (son/daughter/friend) needs to intervene and help him get this stuff out as it was obviously weighing on his mental health.
As of today, the shop space is still unusable to me, and it appears that this song and dance will continue for the foreseeable future.
My question, at what point would you draw the line, and at what point does the stuff legally become “mine”. I don’t plan to take the stuff just curious.
Edit/Update: I really appreciate the responses, still sorting through as I’ve been in move-in project hell. I do want to add that the man has built a $750k brand new home approximately 2 miles from here, with a shop for all of his tools. He also has 2 grown children (son/daughter), an active church family, a lot of friends (of all ages), and I’ve also offered every day to help him move it, which he declines. He is certainly not going to assisted living or does he have any major ailments that are effecting him. It’s clearly an emotional connection to the home (completely understandable, but…) and this is a convenient excuse to still be here and have access to the home. Again, sympathetic to the situation, just wish it would have been expressed at any point in the 2 months from contract to close.
