“Yet drug dealing is now done with such impunity on the streets of downtown Portland that it is possible to walk up and film the transactions.” This is just difficult to read. It’s fine to debate the inequalities in the bail system but that doesn’t mean we should just let crimes happen without impunity or consequences.

The judge denied it but Schmidt supported the overall approach to giving the judge this leeway and they collaborate on approaches to bail. He has said that he doesn’t favor cash bail but afaik hasn’t proposed any alternatives. Lots of judicial failures here where the legislature should just set policy
