Hope someone can help me out/provide experiences and opinions... Quite a long post, but I feel it's necessary so I can provide full context.
Pre-December 2019, our family has been doing well financially and are able to pay for the car loan... Which is under my name. Come January 2020, we started to struggle and unable to pay on time. Like, we can still pay, but we were almost always late. Then after that, the pandemic has hit us harder that we struggled even more to pay for it regularly. I mean, we can make payments from time to time, although not enough to cover the whole amortization amount (plus backlog).. This has went on for months.. But now, as we start to get back on our feet, we figured that we can pay again regularly. The thing is, it's hard to get back on track because of our unpaid amortizations.
I did try to reach out to the bank (PSBank) as early as January of this year to share our predicament and ask for more suitable repayment options that are easier for us.. To no avail. They just said they can't do anything because the amortization is what's in the contract.. So I'm like.. Okay understood.
But just today, I received a call from them again reminding us about the 58k worth of backlog we have that we need to pay immediately. I said we don't have that amount right now, and shared to the rep who called me about our situation. The heartless bastard didn't even care (are banks here really this stone cold?) I asked if there's a way to spread out our backlogs that will be easier for us financially. Still to no avail. Only options he gave me are to pay for the 58k upfront, or voluntarily surrender the vehicle. No in-between.
Now, my family mentioned that we can only produce 40k at most by Monday, which is the day the rep said he will call back for my decision. I know this is a long shot, but I'm planning to go the main branch myself on Monday so I can speak to someone personally.
So my questions are: 1. Is there a specific person/department I can speak to at PSBank main branch about the situation? 2. Do we have some sort of rights/protection that we can use in these kinds of situations? Especially now that we're in a middle of a pandemic.
PS: at this point, giving up the car may be a far option. Our family needs it, especially that public transport now can be a challenge. We also use it in case of emergencies (e.g., when lola had to be rushed to the hospital). Also, we are now on the third year out of the 5-year amortization, so anything we can do to continue paying for it, will be considered.
