Hello.
I was recently in a car crash where I was going to turn to the left, and had my blinker on. For some reason, the guy behind me thought that I was blinking to the left, and slowing down, because I wanted him to pass... Well, surprise, I wasnt, I was actually turning to the left. I had already slowed down to around 25 km/h (this is an 80 zone, and it was dark), and began to turn to the left. and then suddenly he had plowed into the side of my car.
Since I had signaled well in advance, and he clearly misunderstood the situation, he was relatively compliant in that this was his fault, because he tried to pass me when I was clearly signalling that I was turning left onto another street. Fast forward to today, and the insurance company says that it is my fault, because on the road passing is allowed, and that I should have checked my mirror to make sure I wasnt getting passed before I started my turn.
First off, what the fuck. Second, this guy was WAY back when I started signalling my turn, and didnt slow down. I signaled well in advance since it was dark and an 80 zone, so that they would know, from WAY back, that I was planning to turn. I didnt even see him switch lanes, and he was just suddenly in my side, since he was till travelling 80. See below for a rather crude drawing of the situation. Am I seriously at fault for this? This seems like the most unfair decision of all time...
I feel people are missing something important here, did OP signal before or during the overtaking.
Was the other car already in the other lane when OP turned on his blinkers?

Sounds to me that the other driver was already in full overtake mode when OP turned on his signals.
If I can picture this scenario then the insurance company can too.
