When is it legal to shoot someone fleeing from your house with stolen possessions?

So shooting someone and killing them while they flee is murder regardless, but what if I just nick them in the leg or something? Is it legal to do that? If it's not legal, what am I supposed to do other than let them get away with my posessions?
