How can Uber eats legally leave me in limbo with my food?

I ordered food and now it’s saying there’s no drivers available after I ordered. I cannot cancel my order I have to wait and see if drivers become available. I phoned the restaurant and they said yeah when that happens there’s a 3 hour period where if a driver becomes available I get my food, if not then I get a refund. Keep in mind estimated time when I ordered was 20 minutes.

How is this legal? I’m stuck now. Can’t get other food because there’s a chance I’ll have this food delivered the second I take a bite of something else. But then there’s also a chance I never get this food.
