Moving forward after a Failure to Stop W/IN Assured Clear Distance Citation
Post Body

I know this isnā€™t a legal subreddit necessarily, but I had a question regarding the traffic predicament I am in.

I am curious on the best plan of action in the scenario that you are a given a ticket for Failure to Stop W/IN Assured Clear Distance after an unfortunate fender bender involving three cars. For context, I received the ticket since I was the last car and therefore ā€œat faultā€ even though I tried to stop to the best of my ability given when I saw the cars brake lights ahead of me, there just wasnā€™t enough time and it all happened so fast. This was in Michigan by the way. Thereā€™s no fine posted, so I assume I have to go to court and they will issue my points and fine there after appearing within 10 days.

However, the issue lies in contesting the points itself and whether it will work out or possibly get me in more trouble. I got an MIP, which is a civil infraction in my state, 2 years back and was wondering how that would impact my experience if I admit responsibility with explanation and schedule a court hearing for this. I know thereā€™s no points on my license from the MIP, and when I obtained a copy of my limited driving record, the case itself and what not wasnā€™t on there. I guess Iā€™m wondering, if I appeal the points, do I even have a chance? Or will they question me further and possibly make things worse? Iā€™m not even sure if the court would know or not, and if they ask about previous history I know itā€™s best to be honest.
