A. Protection of the Popular Vote
i. All government offices with powers beyond those of ordinary citizens shall be created and filled by popular vote. No office may have the power to contradict or override a popular vote for any reason.
By using the above right clearly stated in the constitution, I start a popular vote (that should close in 24 hours) to make a separate runoff between the judge candidates DroidJoe and Godomasta. Whichever candidate gets the most votes will hold the position; if both candidates tie, another runoff with the same rules will be posted. The reasons for overriding the government's decision to almost "appoint" a judge in a nondemocratic, nonconstitutional, nonethical manner are the following:
Arbitrariety of the decision: Almost three days after the voting period closed, DroidJoe was declared the winner of the election. This decision wasn't in compliance with the constitution, as the protocol for this kind of scenario isnt reflected in the appropriate article, therefore making the decision arbitrary.
Unilateral nature of the decision: No government official has made any clarifying statements before taking the decision of declaring a winner. The many arguments I, along with other citizens, voters and candidates presented clearly weren't taken into account in this process, making this decision unilateral and shows that it doesn't follow the democratic values of Mount Augusta. The issue should have been more openly discussed before announcing a ""solution"".
Candidate not fit to hold the position: The candidate declared as winner does not have the constitutional right to act as a judge, as he currently also holds a cabinet position, clearly violating Article V, Section E. Shared Government Positions. This makes the result largely unconstitutional.
These and many others points are the reasons for calling a popular vote to make a separate runoff. All those in favour of making a separate runoff vote Aye.
