Private Pylons in Mount Augusta - A Legal Opinion

We may need to introduce a bill to reinforce the legal interpretation that the construction of a private pylon in Augusta is a form of theft. First though, I think it might behoove us to ask the Mount Augustan court for a summary judgement regarding the matter. This essentially means that the court will issue a statement on whether or not a particular action is legal without the need for an actual trial and without any respect to actual punishment or any existing cases. It's essentially a summary of what would happen if such a case went to trial. The IRS does something similar all the time for employee/independent contractor determinations. We recently had a Mount Augustan citizen declare the cheeky intention to build a private pylon. As mayor, I have nothing against any particular citizen, and while I extend that indifference to this particular citizen, the construction of a private pylon that impacts our aether claims is something that I wouldn't tolerate from any player.

By putting a pylon that puts the shard over capacity, you are reducing the capacity of existing pylons. According to the labour theory of property, by the construction of these pylons, the owners have mixed their labour with the natural resource of "aether capacity" thereby gaining ownership over it. By placing that additional pylon, you are stealing aether from the owners of the existing pylons. This is theft. This is a sound legal and philosophical interpretation that would likely hold up in court; however, if it does not, I think we might need to throw something in the constitution. I doubt that will be necessary unless this particular private citizen is an expert e-lawyer.

Mount Augusta Criminal Code Sec 200.01.1.a. Theft of Property "Intentionally takes and carries away, transfers, conceals, or retains possession of property of another without the other's consent and with intent to deprive the owner of possession of such property.

Building a pylon carries away the aether capacity that is in the possession of the current pylon owners and it would thereby "deprive the owner of possession of such property."

Shall we take it to the court, or shall we amend instead? Discuss.
