//Based on an older post I found on the sub and a recent judicial issue I'd like to propose something along the following lines.
Section 0
- Whereas, citizens can currently be detained on reasonable suspicion despite being innocent.
- Whereas, it is possible for the court system to be swamped with cases and operate too slowly and with high inefficiency.

- Whereas, it is ethically questionable to deprive a possibly innocent citizen of his or her freedom over a minor criminal violation.
Section 1
Be it resolved that a system of optional bailment be created to provide citizens the option of maintaining their freedom while a trial plays out.
- The Lord-Mayor and the judges shall be charged with splitting criminal acts into two categories, based on severity referred to as "felonies" and "misdemeanour’s" or any such terms with the former being ineligible for bail and the latter being eligible. This document shall be appended to the criminal code in a new category and/or as a bullet point under existing definitions of criminal acts, but shall have no effect on sentencing or determination of guilt.
- A pearled individual who had valid Mount Augustan citizenship at the time of the pearling, charged with a crime deemed a "misdemeanour" or the selected term shall be eligible for bail. This determination shall be made by the first judge to log in following the pearling.
- The citizen must request bail by making a post with the tag "[BAIL]" in the justice subreddit.
- The judge shall set the bail based on potential reps for the purported criminal act of which there must be reasonable suspicion. In cases where there is a significant risk that the defendant will re-offend upon release or flee the territory, the judge may choose to deny bail.
- Once the determination of bail is made, the pearled citizen shall have the option of paying the bail whereupon, he or she shall be released for the duration of the trial. The released citizen shall be forbidden from leaving Mount Augustan territorial claims for the duration of the trial but shall be free to move about therein without threat of violence.
- Bail shall be held in a secure location to be determined by the Lord Mayor and judges and for liability purposes shall never exceed 20d. If higher bail is deemed necessary, no bail shall be granted and the pearl will be held.
- If the trail exceeds the statutory length for holding a pearl on reasonable suspicion, the bail shall be returned to the citizen despite the fact that no determination of guilt or innocence has been made.
Section 2: Definitions
- Citizen shall be defined as any individual with current voting rights as defined in the constitution. (Article I Sec. A)
