What if the phone was just switched off - there would be no GPS or other location data?
What is more likely - the phone was switched off at 2.47am, or the phone lost cell service while in the centre of a University town surrounded by 5 AT&T towers, and then travelled to near Blaine passing close to another 8 AT&T towers without regaining any cell service?

It would, but his location derived from phone data at 4.48am is well within 28 minutes travel from King Road, so cannot be an alibi. Similarly the last known location at 2.47am is not exculpatory.
Any GPS data would have been obtained post-arrest, so would be subject to the gag order and cannot be made public pre-trial.
While the tactics and argument look more than a bit disingenuous, one must have more than a sneaking regard for Ms Taylor's efficacy at using these filings and motions to make public her point, despite the subject area specifically being sealed and the gag order. This part of the motion to unseal IGG seems to ask and answer and make the exact point, without any actual unsealing....:
If the basis for "FBI violated own rules" is correct, we could perhaps assume that genealogy service was accessed using the public portal that does not allow LE use?
