Misuse of Drugs (Reclassification of Substances) Amendment Bill 2021

The Parliament of New Zealand enacts as follows:

1. Title

This Act is the Misuse of Drugs (Reclassification of Substances) Amendment Act 2021.

2. Commencement

This Act comes into force on the day after the date on which it receives the Royal Assent.

3. Purpose

The purpose of this Act is to reclassify substances defined in the schedules of the Misuse of Drugs Act.

4. Principal Act amended

This Act amends the Misuse of Drugs Act 1975 (the principal Act).

5. Schedule 1 amended (Class A controlled drugs)

In Schedule 2 Part 1 clause 1, omit “Lysergide (N,N-diethyllysergamide or lysergic acid diethylamide)”

6. Schedule 2 amended (Class B controlled drugs)

In Schedule 2 Part 1 clause 1, omit “MDMA (2-methylamino-1-(3,4-methylenedioxyphenyl) propane)” and Cathinone (2-amino-1-phenylpropan-1-one).

7. Schedule 3 amended (Class C controlled drugs)

In Schedule 3 Part 1 clause 1, insert the following item in the appropriate alphabetical order:

(1) Lysergide (N,N-diethyllysergamide or lysergic acid diethylamide)
(2) MDMA (2-methylamino-1-(3,4-methylenedioxyphenyl) propane)
(3) Cathinone (2-amino-1-phenylpropan-1-one)

Explanatory Notes

General Policy Statement

This bill will reclassify LSD, MDMA and Cathinone as Class C substances.
