Criminal Justice ("Gay and Trans Panic" Amendment) Act 2019

A BILL TO

Prevent the discovery of a murder victim’s sexuality to be used as justification for a defence.

Be it enacted by being passed by the Northern Ireland Assembly and assented to by Her Majesty as follows:

Section 1: Amendment of Relevant Clauses

(1) Within section 5, a new subsection (1D) is inserted as follows:

(5) (1d) It shall not be a reasonable explanation or excuse for the purposes of the affirmative defence of extreme emotional disturbance that a defendant's conduct resulted from the discovery, knowledge or disclosure of the victim's sexual orientation, sex, gender, gender identity, expression or sex assigned at birth.

Section 2: Extent, commencement, and short title

(1) This Act shall extend across Northern Ireland.

(2) This Act shall come into force immediately after receiving Royal Assent.

(3) This Act may be cited as the Criminal Justice (Amendment) Act 2019.
