Ancona Duck Bill 2019

Set up a conservation area for the Ancona Duck in Northern Ireland; and for connected purposes.

BE IT ENACTED by being passed by the Northern Ireland Assembly and assented to by Her Majesty as follows:—

Section 1: Definitions

(1) A “conservation area” is an area principally reserved and dedicated to the preservation of wildlife.

(2) In this Act, “interfering with the well-being of the Ancona Duck” is defined as—

(a) Intentionally killing an Ancona Duck.

(b) Preventing the birth of Ancona Ducks.

(c) Intentionally injuring an Ancona Duck.

(d) Removal of an Ancona Duck or its offspring from the conservation area except for veterinary purposes as approved by a relevant department.

Section 2: Conservation Area

(1) There is to be a conservation area to preserve the Ancona Duck.

(2) The conservation area must be situated on an inland body of water suitable for harbouring nesting areas for the Ancona Duck.

(3) The boundaries of the conservation area are to—

(a) be over 1km², and

(b) be defined by the relevant minister, and are to be on land held or acquired by the Northern Irish Executive for this purpose.

Section 3: Prohibited activities

(1) It is prohibited to engage in an activity in the conservation area if it interferes with the well-being of the Ancona Duck.

(2) The fine for engaging in an activity in the conservation area which interferes with the well-being of the Ancona Duck will not exceed level 4 on the standard scale.

Section 4: Miscellaneous

(1) The relevant Minister will be able to add provisions to 1(2) as needed.

Section 5: Extent, Commencement and Short Title

(1) This Act extends to the whole of Northern Ireland.

(2) This Act shall be referred to as the “Ancona Duck Act 2019”

(3) This Act will come into effect two weeks after receiving Royal Assent.

Omit section 1 (2) and section 4.

Explanatory note, causing unnecessary suffering to animals which would include all of those acts is already an offence under section 4 of the welfare of animals act 2011 with proper sentences of up to a year in jail and £20,000 fines.

I see no reason for these separate fines to exist for a single species.

Explanatory note, “well being” is so ill defined and encompassing that this is a malformed offence and should be removed.
