My Lords, A01 passed (C 24, NC 13, P 4) and has been applied to the bill. A02 (C 15, NC 22, P 4) and A03 (c 14, NC 16, P 11) failed. We now proceed to final division.

To

Amend the provisions of the Right to Roam Act 2015.

Section 1: Interpretations

For the purposes of this Act:—

“the 2015 Act” shall refer to the Right to Roam Act 2015.

Section 2: Amendments

the 2015 Act is amended as follows

(1) Section 1 (Access Rights), Point One, strike the word ‘everyone’ and replace it with ‘Any UK Citizen’.

(2) Section 1 (Access Rights), Point Five, strike and replace with ‘A person has access rights only if they are exercised in accordance with any rules established by the lawful holder of said land’.

(3) Section 2 (Exemptions from the access rights), Point One, sub-point II, strike in entirety.

(4) Section 3 (Conduct excluded from access rights), Point 1, sub-point C strike in entirety.

Section 3: Short title, commencement and extent

This Act may be cited as the Right to Roam Act Amendment (2022) Bill. This Act comes into force immediately after Royal Assent. The Act extends to England and Wales, Scotland, and Northern Ireland.


This bill was written by the Most Honourable the Lord Henry John Temple, Marquess of Caernarfon, on behalf of the United Britain Party.


Opening Speech

My Lords, I beg to move, That the Bill be now read a second time.

Since the assent was given to this bill some considerable span ago, there have been numerous changes that need to be made, which have come to the fore. It is my view that the bill presented today. Firstly, the bill establishes a duty onto the lawful holder of land to ensure that standards are maintained with respect to behaviour on their land by visitors and roamers to it.

Personal agency in this respect is something I firmly believe will go some way to improving the land we hold in common.

Furthermore, I have also included provisions to remove camping and tent placement from the protections. In many cases, such land is ill-suited, especially as successive bills have placed free provision of such land into the hands of local government. Without this amendment, the provision of free space for caravaneers is obfuscated further.

I have also removed the provision which prohibits hunters and fishers from the right to roam, which is, to be blunt, not practical.
