TO
establish bank holidays on various days
BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:
Section 1: Definitions
For the purposes of this Act—
(a) “Election day” is the polling day of any parliamentary general election, as defined in Section 1 of the Fixed Term Parliaments Act 2011.
(b) “Scottish election day” is the polling day of any Scottish parliamentary general election, as defined in Sections 2 and 3 of the Scotland Act 1998.
(c) “Welsh election day” is the polling day of any Welsh parliamentary general election, as defined in Sections 3 and 5 of the Government of Wales Act 1998.
(d) “Northern Irish election day” is the polling day of any Northern Irish parliamentary general election, as defined in Sections 31 and 32 of the Northern Ireland Act 1998.
(e) “Referendum” is defined as a referendum or other poll held, in pursuance of any provision made by or under an Act of Parliament, as defined in Part VII, Chapter 1, Section 2 of the Political Parties, Elections and Referendums Act 2000.
Section 2: Amendment to the Schedule
(1) After Schedule 1 Section 3 of the Banking and Financial Dealings Act 1971 insert a new section and title it “The following are to be bank holidays in Wales:—”, and renumber accordingly
(2) Retitle Schedule 1 Section 1 to “The following are to be bank holidays in England:—”
Section 3: Establishing new Bank Holidays
(1) At the end of Schedule 1, Section 1 of the Banking and Financial Dealings Act 1971 insert
(a) “Election day.”
(b) “23rd April. (St George’s Day)”
(c) “Any Referendum.”
(2) At the end of Schedule 1, Section 2 of the Banking and Financial Dealings Act 1971 insert
(a) “Election day”
(b) “Scottish election day”
(c) “30th November. (St Andrew’s Day)”
(d) “Any Referendum.”
(3) At the end of Schedule 1 Section 3 of the Banking and Financial Dealings Act 1971 insert
(a) “Election day.”
(b) “Northern Irish election day.”
(c) “17th March. (St Patrick’s Day)”
(d) “Any Referendum.”
(4) At the end of Schedule 1 Section 4 of the Banking and Financial Dealings Act 1971 insert
(a) “Easter Monday.”
(b) “The last Monday in May.”
(c) “25th January.”
(d) “26th December, if it is not a Sunday.”
(e) “27th December in a year in which 25th or 26th December is a Sunday.”
(f) “Welsh election day”
(g)“1st March. (St David’s Day)”
(h) “Any Referendum.”
Section 4: Short title, commencement and extent
(1) This Act may be cited as the Bank Holidays Act 2021.
(2) This Act comes into force one month after the passing of this Act.
(3) This Act extends to the whole of the United Kingdom of Great Britain and Northern Ireland.
(a) This act shall not extend to Scotland until the Scottish Parliament has passed a legislative consent motion.
