B1555 - Pay Transparency Bill - Amendment Division
Post Body

Pay Transparency Bill

Note: 1 spag amendment

A01

Leave out "legally permissible" from clause 2(1)(e).

EN: Experience and tenure aren't always permitted factors for pay. They are indirect discrimination under the Equality Act 2010, so they must be a proportionate means of achieving a legitimate aim. Plus, if this duty is to exist, employers should be under a duty to declare potential unlawful factors too.

A02

Clause 1, leave out subsection (1) and insert—

(1) In this Act, a "qualifying employer" is an employer with ten or more employees.

In the subsequent clauses, leave out all instances of "firm" and insert in their place "qualifying employer", and leave out all instances of "firms" and insert in their place "qualifying employers".

EN: Firms would exclude sole traders (see the Companies Acts for example). There are some pretty big sole traders out there, so they should also be covered.

A01 and A02 were submitted by /u/model-kurimizumi.

A03

In section 5(1) omit “60 days” and insert “1 year”

EN: this bill will add a big burden on many bus’s issues and will mean changes to their systems that take time.

A03 was submitted by /u/meneerduif.

This division ends on Thursday 22nd June at 10pm BST.
