KS1 SATs (Reinstatement) Bill
A01
In clause 3(1), substitute "an optional" with "a".
In clause 3(1), substitute "may" with "must".
In clause 3(2), strike "that choose to assess their students using SATs"
EN: Makes the KS1 SATs mandatory.

In clause 3(8), substitute "may" with "must".
EN: Makes the grading of school performance by the Authority mandatory.

In clause 3(7)(b), substitute "may" with "must, where a school has previous SATs results,"
EN: Makes comparison of SATs over time mandatory, to allow readers of reports to understand how the school is doing over time.

Insert new subsections (11) and (12) at the end of clause 3:
(11) A school must not disclose to a pupil, or family member or carer of a pupil, the results of that pupil in their SAT, except insofar as it is necessary to disclose it to provide additional educational support to the pupil.
Insert a new clause 4 after clause 3:
Section 4: Amendment of the Data Protection Act 2018
Insert at the end of Schedule 3, Part 4 of the Data Protection Act 2018:
Restriction of Article 15 of the GDPR: KS1 SATs results
- The right of access under Article 15(1) of the GDPR does not apply to data relating to the results of SATs under the KS1 SATs (Reinstatement) Act 2023.
Renumber the existing clause 4 to clause 5.
EN: This makes it so that pupils are not permitted to obtain their marks, and schools must not disclose them unless required to provide additional support to that pupil. This prevents the KS1 SATs becoming competitive and reduces the risk of pressure being placed on pupils by parents.
