B242 - National Transport Service Bill - Third Reading

Order, Order

A bill to Restructure the Transport funding of the United Kingdom of Great Britain and Northern Ireland BE IT ENACTED by The Queen's most Excellent Majesty, by and with the advice and consent of the Commons in this present Parliament assembled, in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:-

 

.1. Definitions

a) A government owned transport service is a domestic train, ground based motor vehicle, trolleybus, tram or ferry, which is either operated directly by the government, or by an organisation, the purpose of which is the transportation of passengers, the majority of which is owned by the government.

b) Network Rail is the infrastructure manager of the railway network in England, Scotland and Wales.

.2. The Restructuring

Government owned transport services may not charge passengers money for travel, nor restrict the access to the transport services in any manner, except if the transport service is restricted to a certain institution such as a school, or if any of the grounds determined in section 3 are met.

.3. Grounds for denial

A passenger may be denied access to a transport service if:

a) It the service is full or unavailable or potentially dangerous

b) If the employee has grounds to believe the passenger has committed or is committing or is going to commit a criminal offence during their journey

c) If the passenger is behaving in a manner potentially dangerous to other passengers

d) If the passenger is holding potentially dangerous items

e) If the person is smoking or drinking in an area, in which it is prohibited

f) If the person is using threatening, abusive, obscene or offensive language

g) If the person is displaying anything for the purpose of advertising or publicity, or distributing anything

h) If the person is selling or exposing or offering anything for sale or tout for, or solicit money, reward, custom or employment of any kind.

i) If the person is bringing an animal to a place, where such is prohibited

j) If the seat has been reserved by another person

.4. Democratisation of the transport services

a) All government owned transport with services exception to Network Rail are to be overseen at a national level by the Secretary of State in coordination with major labour unions operating within and organising employees within government owned transport services.

b) All government owned transport services with exception to Network Rail are to be managed, at a regional and individual service-level, by direct and participatory procedures as laid out and overseen by major labour unions organising employees within government owned transport services of that region or service, and the Secretary of State, as well as approved by both the secretary of state and a majority of employees in relevant region or service.

d) All government owned transport services with exception to Network Rail are to be managed at workplace-level by direct and participatory procedures overseen by major labour unions organising employees within government owned transport services in that workplace as approved by a majority of employees in that workplace.

e) A majority of the Executive Board of Network Rail is to be elected directly by employees of Network Rail.

f) Network Rail is to be run at a regional level by bodies directly elected by employees of Network Rail in that region, as overseen by the Regional Members’ Councils through procedures laid out by the secretary of state in coordination with major labour unions organising employees within Network Rail in that region.

g) Network Rail is to be run at a workplace level by employees in that workplace through direct and participatory processes as laid out and overseen by any relevant Regional Members’ Councils and major labour unions organising employees in that workplace as approved by a majority of employees in that workplace.

.5. Commencement & Short Title

a) This act extends to whole of the United Kingdom.

b) This Act may be cited as the National Transport Service Act of 2016

c) This act will come into effect 2 months after passing
