A bill to allow for the transfer of breast milk to the NHS and to allow for the sale of this milk to the general public.
BE IT ENACTED by The Queenโs most Excellent Majesty, by and with the advice and consent of the Commons in this present Parliament assembled, in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:โ
Section 1: Establishment of the National Milk Bank
The National Health Service shall take control of all UK milk banks.
The National Health Service will provide milk pumping services to any producers who meet the criteria laid out in Section 2.
The National Health Service shall establish facilities for the storage of all milk produced.
These facilities shall be known as "National Health Service Milk Banks"
Every Clinical Commissioning Group in England, Scottish Health Board, Welsh Health Board, and Health and Social Care in Northern Ireland shall be responsible for the creation and maintenance of these facilities, in addition to being responsible for the administering of the regulations set out in Section 2.
The breast milk shall be stored and disposed of in accordance with regulations produced by the Department of Health.
Section 2: Provisions for Regulation of Milk Donors
The Department for Health shall produce a set of criteria that all producers must meet.
The facility shall be responsible for ensuring these criteria are met.
The violation of these regulations shall result in the application of a fine to the organisation responsible for the offending facility.
Section 3: Distribution of the Milk Stored
Every district general hospital shall be responsible for the distribution of the stored breast milk to mothers, caregivers, and legal guardians of children under one year of age who are at risk of being nutrient deficient or in any case where breastfeeding is impractical or unsafe.
Risk of nutrient deficiency and unsafe breastfeeding shall be assessed by the distributing hospital.
There shall be no charge for the breast milk received.
Section 4: Provisions for the Ownership and Sale of the Breast Milk
The organisation responsible for the extraction of the breast milk from the Producer shall take ownership of 50% of the breast milk produced by volume.
The Producer shall take ownership of the remaining 50% produced by volume.
The Producer shall be free to sell the product to any willing buyers.
The breast milk may be used in the creation of any other product.
Any food items produced using the product shall be subject to further scrutinisation by the Food Standards Agency.
Section 5: Commencement, Short Title and Effect
This bill extends to the United Kingdom of Great Britain and Northern Ireland
Section 1 and Section 2 of this bill comes into force on the day on which this bill is passed. The remainder comes into force one year after this bill is passed.
This bill may be cited as the Breast Milk Trading Act 2016.
