Since r/Uberdrivers is not allowing people to see my post I am going to post it here, hopefully you all can see itā¦ this post is for Uber not Lyft, but most Lyft drivers drive for Uber anyway so here you goā¦
Two months ago, I faced a deactivation from Uber, alleging harassment and sexual misconduct with a passenger, despite a lack of supporting evidence. The passenger never reported any such incidents. Hereās the story:
I frequently drove for Uber, particularly on weekends.
On one occasion, I headed to the airport near my home, hoping to get rides to a college town to connect with people my age. During this trip, I picked up two young women, and we had a conversation. At the end of the ride, I asked one of them for her number, which she willingly shared. I then turned off my app, and we went for a walk as there wasnāt much else to do.
During this hangout, one of the girls was friendly, while the other was not. The unfriendly one decided to return home, which was fine by me. I dropped them off and asked the other girl if she wanted to continue hanging out, to which she declined. I resumed driving for Uber, thinking everything was okay.
Subsequently, the friendly girl messaged me, inquiring if I only wanted to hang out for sexual purposes. I denied this and explained that her friend wanted to leave. She then accused me of seeking sex, blocked me after taking screenshots of our conversation, and hinted at reporting me to Uber. Thatās when I decided to keep evidence. The next morning, my Uber account was under review.
Uber claimed I breached their guidelines regarding harassment and sexual misconduct, despite the passenger confirming our consensual agreement to exchange information and hang out. Uber refused to acknowledge this, which left me infuriated. Uberās guidelines state that āContact should end when the trip or delivery is complete unless itās to return a lost item.ā The use of āshouldā indicates itās not a demand. Thereās a reason this $100 billion company used that exact word in their guidelines.
Furthermore, there is no prohibition against drivers and passengers exchanging contact information or meeting up after a trip with mutual consent.
Ultimately, Uber deactivated my account, citing their Community Guidelines. Iām currently pursuing legal assistance and arbitration to reinstate my account. I possess substantial evidence to demonstrate my innocence and believe that Uber made an ill-informed decision by neglecting my side of the story. If anyone has experience or advice on handling such a situation, your input would be greatly appreciated.
Before commenting, itās essential to note that the Terms of Service do not explicitly prohibit the exchange of contact information when itās consensually agreed upon. I have proof that everything was consensual, and even the passenger has corroborated this. Iāve also sent a letter to Uberās legal department, detailing my situation and providing evidence, so letās see how that progresses. Does anyone have experience with reclaiming their accounts, or are there any lawyers who have dealt with Uber deactivation cases?
