Question about shifting Diablo Devoted Herald

Last night I played with a friend on TTS and they said that I cannot shift Diablo Devoted Herald onto a wet Diablo Maleficent's Spy. Also on top of that i was trying to discard a song card because in the category section it says "Action" and "Song" but I was told that it needed to only say action for it to count.

So my questions are:

1)Can Diablo Devoted Herald shift onto a Diablo that is still wet?

2) Can I use a Action&Song card to pay for the shift cost or does it have to a card that ONLY says Action?
