Von duprin concealed vertical cable ED not latching reliably

Model 49 I believe, isn't latching reliably. First photo is what that part I'm touching is doing when it's supposed to be latching but isn't, second is what the identical but functioning other door is doing.
that part is scraping against the metal cover and is only latching maybe 80% of the time, and I've got it disassembled but can't figure out why that part isn't laying flat the way it's supposed to; seems like a bad design honestly.
