Okay so I deliver pizza in Indiana and my employer pays me two different rates. I make 7.25/hr while I'm in store but my pay gets decreased to only 3.35/hr while I'm on the road for deliveries. I get that for some stupid reason employers are allowed to pay less for tipped employees because of the tips (it doesn't really make sense to include tips into my pay since the employer isn't paying those tips and they aren't guaranteed) is it legal for her to decrease my pay while I'm out on delivery? It seems to me that decreasing someone's pay while they're making tips isn't legal. It would be if I was getting paid a lower rate the entire time I'm there but to drop my pay while I'm on the road doesn't seem legal.
