I'll go straight to the TLDR. We won a court case against a developer in Davao who basically took my wife's life savings and was supposed to build a house from it. This never happened, took them to court and the HSAC ruled in our favour. Since then, all we've received from HSAC are these nonsense progress update from the sheriff carrying out the writ of execution that negotiations are ongoing.
What negotiations they refer to, I don't know. My wife has never been contacted and we don't even want to negotiate. The way she sees it, there is the verdict and the proceedings therein.
So i have three questions:
Why is there still this idea that there can be negotiations with a sheriff when the verdict has already been cast?
Why does the HSAC not do anything about this?
And third: is there anything we can do to get the sheriff to simply do his job and collect the proceedings from the verdict?
We're extremely frustrated and disillusioned with this, and we're afraid we will never see her hard earned money ever again. Any advice would be greatly appreciated!
