Hello everyone
I’m a legal executive however I only specialise in criminal law so I am a bit confused with this one. Though I believe my understanding is correct I would appreciate a second opinion.
A few months back I hired a vehicle under my limited companies name.
The contract under “our details” names the hirer company. Under “your details” it lists my limited company. I signed the contract on behalf of the company.
Note that my name in a personal capacity does not form part of the agreement. I am not a party to the contract.
Fast forward to the present day and the company have invoices me for four tyres and minor scratches.
They have invoiced me personally.
I do not believe this to be correct. I emailed them advising they must address the limited company and not myself. But they refuse to do so.
What is the legal position here?
If they refuse to address my limited company and start any action against me personally do I any footing?
Thank you!
Joe
