Hi!
So we bought a hot-tub off Facebook Marketplace. Obviously second hand. It was advertised by a company, not an individual. We went to see it. It was on a property that we had been to before to look at things (that we'd had no problem with). The guy who owned the property was not selling the hot-tub, he was just storing it for his friend. His friend met us there and showed us it.
Anyway, we bought it, they delivered it - all good. My husband was cleaning it and the bottom just gave way (fibreglass) and cut his toe open in two places, resulting in a trip to minor injuries. The bottom had already had a repair, which we weren't told at the time. Obviously the repair wasn't very good. We called the seller, he came round straight away and said he would sort it - either a refund or a repair. But then he just started ignoring texts and now nothing. The company page has disappeared off Facebook. We don't even have his name. We have screenshots of the advert and our messages showing the hot-tub was being sold by a company and that the previous repair had not been declared.
Obviously we'd like to go to the small claims court but we have no name (other than a now non existent (and never official probably) company name). We have a phone number (if he hasn't changed it) and an address of his friend.
Is there anything we can actually do? Or it it just a matter of letting it go?
