Communal factoring for garden and green space maintenance (Scotland)

Post Body

I purchased a house in Scotland 5 years ago and was told at the time that factoring would be required going forward and essentially by buying the property I was agreeing to pay a factoring charge for the upkeep of the green space. The detail was that the contract had been signed by the land owners prior to signing it over to the developers.

2 years after that, the estate is still expanding and another company has joined in. They are also requesting payment for green maintenance and are using the same argument. It was pretty arranged etc. I'm currently refusing to pay the second company because a) it's not my contract and I didn't sign acceptance and b) I have no idea what they're actually doing.

I'm not happy with paying one never mind two but the second company is now threatening court action and 'telling my neighbours ' about my non payment.

Can anyone advise on the legal view of this please? Can they take court action to force payment for something I didn't agree to uphold?
