My parents moved into a gated community with leasehold falts, they own the freehold house behind these flats.
The residence association, which deals with only issues for the peoplein the falts e.g. getting new floor mats etc, made a decision that dogs are not allowed in the place a couple of years before we moved in. The document states 8. Dogs are not allowed to be kept by any residence of 'Gated Community name'. This is to prevent annoyance and nusiance.
A seperate contract about the use of the land and woodland. The plan has a redsquare of land that is 'ours' but is basically treated as in common, with it saying that anyone is allowed to go in and out of it. The rest of the land is all held in common for use. the contract states:
- the licensee shall comply with: any rules and regulations governing the licensees use of land; and all laws relating to the land and use of land
This is only about the surrounding land and not in the home itself.
When i bought the title register on gov.uk it very unhelpfuly only said this about any covenants that may be on the property:
The land is subject to such restrictive covenants (if
any) as may have been imposed thereon prior to
first registration and are still subsisting and
capable of being enforced.
The letter from the lawyers says the property is subject to serveral covenants, we have listed out several that need to be brought to your attention [...]
the propety is subject to these covenants:
and then list only 3 covenants, one of which is not to cause annoyance or nuisance.
So my questions here are:
Can the residence association stop us from owning a dog inside our own property?
Can they stop us from having the dog in the red area of land behind the home that is our in name but not really in use?
And where can i find the covenants on the property. The lawyers phrased it as if there were loads but then listed three as if they are the onea nd only and the title deed has none.
are there any rules surrounding on if its legal to stop people from owning a dog in there own property in a gated community?
