Posting on behalf of a friend so forgive me if I donât have specific details. I understand sheâll probably need to seek legal advice, but some direction and any backup information would be really helpful for her.
Her ex-husbandâs grandparent died, and his will stated that each great grandchild should get a trust set up for them of a five figure sum.
This money has been paid (many months ago, less than a year) to the parents of the great grandchildren - her ex husband - but he has not set up a trust or paid the money anywhere. Sheâs concerned he has spent the money, which would be very on brand for him.
She has spoken to him and asked for some evidence that the trust has been set up for their son, but he tells her heâs âgoing to do itâ.
My questions really are; - Would she have any right to request proof of the trust through official means? - What happens if he has spent the money? Has an offence been committed? - Where should she start in looking for legal advice on this?
Thank you in advance for your time and attention, she has been steamrolled pretty viciously in the divorce and she doesnât want her son to be a victim of his fatherâs poor financial decisions.
