Last year I redesigned a part that is unavailable from the manufacturer as an individual spare and have been manufactuing and selling them online for just over a year now.
My version of the part is an improved redesign of the unavailable part and naturally does share some visual similarities with the manufacturers part, but it is a complete redesign from scratch and not a direct copy.
Where do I stand if I want to register the design?
The reason I want to register is that somone has bought one of these parts from me, copied it 1:1 including my own part number (different from the manufacturers) and has been selling lower quality copies on Ebay and Amazon, they have even gone as far as stealing my own photos of the product from the platform I sell them from.
Both myself and the pirate seller are based in England.
Naturally I am annoyed, I put a lot of time and expense into developing this and would like to register my design so I can get his pirated copies removed from sale, but with it being a redesign of a manufacturers part, I want to ensure I am able to do this without infringing on them.
