New development next door

The neighbour has nearly completed a development of 17 houses next door. At the beginning of the project, when we noticed houses being wrecked for demo (asbestos) we finally were able to speak with people involved in the work and were lead to finally be able to connect with the developer (who is a Chinese man that speaks little English) and eventually this lead to a meeting.

During that meeting (arranged by the project manager at my request) we all talked about shared assets on our boundary, a retaining wall and fencing across the western boundaries, and water issues in the land to be developed that impacted our property for the previous two years, we raised our concerns..

The developer and project manager met with the other landowners and in that discussion stated they intended to take care of the assets we were concerned about-and replace them, and fix the water issues, as is usual in these circumstances we all thought and they agreed.

Long story short, many interactions in between, some nice, most unpleasant. The project manager recently advised that they won’t be replacing anything and advised he made a mistake in advising us they would do that in the first instance, the building company followed BC plans and built a retaining wall directly behind the existing boundary wall literally within 40cm (on their land) and intend to do nothing further with the assets that were there prior to development.

The wall is now pretty damaged and cracked after all the dewatering, silt overflows and heavy equipment for months on end. It’s looking sad and our driveway is cracking rather rapidly now too.

They made commitments when we first met, later they are retracting them. During the development we’ve been more than helpful in accomodating their varied requests mainly under the impression shared assets were being taken care of and we were not financially burdened in the process.

That first meeting was called by us to hear their intentions and gain some commitments on the assets concerned, not a meeting where the project manager could spitball ideas based on his experience which is the way they are insisting The miscommunications occurred regarding what would be done with the wall.

obviously they have no intention to remediate and neither the dev or building company seem to care any more as most of the work is done, we’ve been raising this concern with them for the least few months.

We’re at a loss as to how to proceed.
