I have a cousin based in New Delhi, that is interested in establishing a career as a standup comedian, and as such, wants to start uploading content through YouTube videos and podcasts apparently. But seeing as how I don't live in India currently, he would like some help w.r.t copyrighting and trademarking content that he produces, from someone in India that is well versed with the relevant laws.
Basically, he realizes that since activities like podcasting and YouTubing are considered artistic in nature, they are liable to undergo a copyright process (right?). However, he would also like to make an Instagram account or something similar, where he can post his jokes as well, since he hopes to write a book and papers and stuff consisting of all of his jokes, in the next few years.
Now obviously, if my cousin expands his stuff enough to be writing books and produce merchandise based on his content, I am guessing that he will have to apply for a trademark also beforehand? Would anyone mind confirming if both a copyright and a trademark process needs to be completed, or is one out of the two going to be enough?
Additionally, my cousin wants to begin posting his stuff on Instagram and other social media right away, and create accounts accordingly, so should he get started now, or should he wait until the copyright/trademark process is completed?
I am looking forward to some helpful advice and suggestions, thanks in advance for all of the assistance! Peace. :)
