I used to work as a software engineer in a consultancy here in the US. I lost my client job third week of December 2023 but my employer was still paying me my salary till I was VERBALLY informed that they're laying me off as the company doesn't have enough funds to run my payroll last first week of February.
When I asked my employer if I am getting a final pay, they said I'm not getting anything without specifying any context. They claimed I actually "owe" them 80k which I believe a big chunk of it were their expenses in visa/greencard processing that shouldn't be charged on whatever final pay is due to me. We do profit sharing - they get 25% of my bill rate and anything in excess of my hourly rate based from salary should go to my "bonus". (eg if my hourly rate is 30 and I get a 50/hr job. They get 12.50, I get 30, and the 7.50 goes to my "bonus"). In my entire stay with them, I always ask for an accounting of this bonus but they never provided.
Looking at my last paycheck, the coverage period of the pay was December 1-15. My question is, since I was laid off last February 9, am I due for the pay from December 16-February 8 since at that time, I am still considered as employed with them?
