Filing Late Answer in MA
Post Flair (click to view more posts with a particular flair)
Post Body
Have a new civil litigation case and am past the 20 days to file Answer. A Preliminary injunction hearing has been rescheduled by agreement and have had some brief discussions with opposing counsel on potential settlement.
Think I could just file an Answer and counterclaim under these circumstances or do I have to go through Rule 9A process and Motion to file late Answer ? It seems the deadline to file Answer only comes up when one side is seeking a default
