(Not real names used - Landlord in Scotland so looking for Scottish law/ legislation/ guidance) Iām finding it difficult to find information on this. Iām trying to find out how I can enter the property. I have joint tenants - (Jack) hasnāt paid rent, it was due on the 1st so tomorrow it will be 3 days late. This is following an email from the other joint tenant (Amy) stating they would like to end their tenancy and giving her months notice. I have Amyās mum as a guarantor.
Iāve stated that I need it in writing from BOTH tenants before we can officially end the contract, and until both tenants have agreed in writing to terminate the contract, they will both (including guarantor) be liable to continuing paying the rent. I also stated that the rent has not been paid and it is late, and could this be paid asap. I have messaged Jack on WhatsApp (a usual method of communication for us, agreed in the contract), I have emailed him, and I have called twice and left voicemails. No response. Amy replied to the email apologising for the late payment, stating that she had paid her half to Jack and assumed he had paid it. That she cannot get hold of him, that she understands I need his notice in writing too, and confirmed it will be both of them ending the tenancy and Jack will not be looking to stay. That she will sort this asap.
Background - Amy and Jack are young, 19 &21. Moved in in feb 23 and had a baby in June. They broke up shortly after having the baby but didnāt tell us, I just knew from social media.
I am concerned for both the fact he could be trying to do a ārunnerā as I suspect the property might not be in the best condition. Or he might just refuse to pay rent and stay in the property and I canāt get him to leave. But Iām also genuinely concerned for his well-being. Iāve looked on his social media (unsure if this is allowed or if I can use evidence from social media for anything - advice on this would be appreciated). Heās had a lot of recent posts relating to depression. āHalloween is coming soon and canāt decide whether to hang myself or the decorationsā āMan enough to shut tf up and let it destroy me inside mentally because my feelings donāt matter.ā āIām playing it cool like I havenāt been losing it these past few months.ā āYeah Iām ok if my life were to end this second. Iām not saying Iām going to end it but I wish I had the strength to do it.ā
I want to go into the property to 1) check the condition of the property 2) chase up the missing rent 3) chase Jack up on the notice of termination 4) carry our any repairs in preparation for future tenants 5) carry viewings 6) see if jack is ok and hasnāt done anything stupid, after seeing the concerning social media posts
If I havenāt heard from him 48 hours after sending the email (Sunday), I will give him 48 hours notice to visit the property. What Iām concerned about though is things online stating I need his permission to enter the property? - What would I do if I couldnāt get permission - Can I still enter the property after giving 48 hours notice? - If I get permission from Amy but not Jack, can I enter the property with my own set of keys (after the 48 hours of course), if nobody appears to be home after knocking/ buzzing and waiting? - Can we enter ok grounds of being concerned about the tenant? - Can we use his social media posts as grounds for concern?

Your "opinion" is bullshit and based on absolutely nothing. It is in complete contradiction to everything this landlord has said/done and you need to take your child ass somewhere else.
