Hey so my brother and I recently had to abandon the place we were renting in Los Angeles due to habitability. We moved in March of 2021 started running into problems in May (water leaking from ceiling), by August 21 we had (rats) we've had them literally the whole time. We didn't know how bad the situation was mind you I thought it was one or two and I'm not naive I know it's never just one or two, but they were literally eating through the walls, and I literally have video of them for the last 3 months a good 5-6 of them running up and down the stairs, I guess they never came into my room because my dog killed a few downstairs. So my landlord just sent the notice that he's keeping the deposit, due to cleaning, which it was definitely clean we purposely cleaned waited 48 hours went back and took video of all the feces and urine. So when we cleaned it a 2nd time, I'm pretty sure that's what he encountered. I also had code enforcement come out, as well as Terminix twice, and filed 2 cases with the Dept. of Public Health I'm awaiting them to send me copies of the complaints. We want to pursue legal action but not through small claims court, is that our only option via a lawyer.

Our claims

  1. Breach of warranty of habitability

  2. Breach of the covenant of quiet enjoyment

  3. Private nuisance

  4. Negligence

  5. Breach of contract

  6. Violation of Civil Code 1940.2

  7. Emotional distress

  8. We're also asking for the return of all rent funds paid from September of 2021 - Dec of 22 due to the fact nothing was resolved. (Instead, he continuously shifted the blame on us, or to the other tenant, he even had me write a letter to section 8 on the other tenant and she pulled a knife on us and threatened us, yes there's a police report as well)
