Should nanobots be a controlled, licensed substance?

It's the far future of 2323 AD or further, and biologically compatible nanobots have been invented and have unlocked many medical advances. However, they could also be used for a great number of crimes and atrocities. Should such nano-scale sized robots be a controlled substance? And if so, are there any suggestions for how to enforce that regulation? Or perhaps do you think there's no point, so we might as well embrace things like nanobot-hunters and nano-immune systems?

I mean.

As someone who thinks that poly resistant pathogens are probably the most credible threat to the species? Yeah.

There's a lot of places with utterly horrific punishments on importing Kudzu and I think the same rationale should apply here.
