On December 7, the Supreme Court will hear oral arguments in Moore v. Harper. At the center of this case is the “independent state legislature" theory — a claim that state legislators have nearly unchecked power over federal elections. If SCOTUS adopts this baseless theory, state legislators could upend federal elections.
